TERMS OF SERVICE

Thank you for using qwix, a FiveAside Holdings Inc. ("FiveAside") production. FiveAside provides you this service subject to this Terms of Service agreement ("Agreement"). Your use of qwix is conditioned upon your acceptance of all of the conditions of this Agreement. You represent that you are of legal age to form a contract and bind into this Agreement. FiveAside may update this Terms of Service from time to time without notice to you.

1. Service Description

qwix is a service allowing users to shorten URLs. You understand that qwix is a free service, which may rely on third party resources such as PhishTank. You also understand that qwix may include advertisements, which are essential for keeping this service free for you.

2. User Supplied Content

Short URLs created on qwix are supplied by users. qwix has no control of the submitted links other than to perform cursory checks on them using in-house and third-party resources. You understand and agree that qwix disclaims any responsibility for the nature of the URLs submitted our users.

You understand and agree that you may not use qwix in a manner contrary to any applicable law. You understand and agree that you may not use qwix in the furtherance of any illicit or criminal activity.

3. Disclaimer of Warranties

You understand and agree that all of the services under this agreement are provided to you "AS-IS" without any expressed or implied warranty.

You understand and agree that FiveAside may at our sole discretion store, transmit, modify, remove or delete any link created on qwix, without any liability to you or any third-party.

FiveAside makes no claim as to the fitness or merchantability of qwix for any particular purpose.

4. General Provisions

qwix is a service of FiveAside Holdings Inc., a Canadian corporation. This Agreement is governed by the laws of the Province of Ontario and the laws of Canada. You and FiveAside agree to submit to the exclusive jurisdiction of the Ontario Superior Court of Justice located within the City of Toronto.

If you are dissatisfied with qwix or with any provisions of this Agreement, your sole and exlusive remedy is to discontinue the use of the service.

If any provisions of this Agreement is deemed to be void, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

This Terms of Service constitute the entire agreement between you and FiveAside Holdings Inc. in regards to qwix.
